1. Agreement to these Terms

These Terms & Conditions (“Terms”) govern your access to and use of the mobile application, website at thepatientwait.com, and related services (together, the “Service”) operated by The Patient Wait LLC (“The Patient Wait,” “we,” “us,” or “our”).

By downloading, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.

You can begin using the Service without creating an account. Whether or not you register, your use of the Service constitutes acceptance of these Terms.

2. Important medical disclaimer — please read carefully

The Patient Wait is not a medical service and is not a substitute for professional medical advice, diagnosis, or treatment. We do not provide medical care, triage, or clinical recommendations of any kind.

  • The Service helps you locate and compare urgent care centers and emergency rooms and displays estimated wait times. It does not assess your condition or tell you where you should seek care.
  • In a life-threatening emergency, call 911 immediately or go to your nearest emergency room. Do not rely on the Service to determine the urgency of your situation.
  • Nothing in the Service creates a doctor–patient relationship, and no content within the Service should be interpreted as medical advice.
  • Always seek the advice of a qualified health provider with any questions you have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you saw in the Service.

3. Wait times and facility information

Wait times shown in the Service are crowd-sourced estimates contributed by other users, and in some cases derived from third-party or publicly available sources. They are provided for general informational purposes only.

You acknowledge and agree that:

  • Wait times are estimates, not guarantees, and may be inaccurate, incomplete, outdated, or absent for any given facility.
  • Actual wait times depend on factors outside our control, including patient volume, staffing, the severity of other patients’ conditions, and each facility’s own triage decisions.
  • A “last updated” timestamp indicates when an estimate was last reported — not that the estimate is currently correct.
  • Facility details such as hours, services offered (for example, x-ray availability), addresses, and phone numbers may change and may not be current.
  • We do not endorse, recommend, or guarantee the quality, availability, or suitability of any facility listed in the Service.

You are responsible for verifying critical information — including whether a facility is open, accepts walk-ins, is in your insurance network, and can treat your condition — directly with the facility before relying on it.

4. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. If you are under that age, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. By using the Service, you represent that you meet these requirements.

5. Accounts

Some features may require you to create an account or save preferences (for example, saving your regular facilities). You are responsible for maintaining the confidentiality of any credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date. Notify us promptly at Contact@thepatientwait.com if you believe your account has been compromised.

6. User-contributed content

The Service allows you to submit content, including wait-time reports and any other information you provide (your “Contributions”).

Your responsibility. You are solely responsible for your Contributions and represent that they are accurate to the best of your knowledge, submitted in good faith, and do not violate these Terms or any applicable law.

License to us. By submitting a Contribution, you grant The Patient Wait a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, store, reproduce, aggregate, modify, display, and distribute that Contribution in connection with operating, improving, and promoting the Service. This includes combining your Contributions with those of others to generate estimates. We may retain and use aggregated or de-identified data derived from Contributions without restriction.

Prohibited Contributions. You agree not to submit any Contribution that:

  • is false, misleading, or intended to manipulate or distort wait-time estimates;
  • contains personal health information about yourself or others that you do not intend to share publicly;
  • infringes the rights of any third party or violates any law;
  • is defamatory, harassing, abusive, obscene, or otherwise objectionable; or
  • contains malware, spam, or automated or bulk submissions.

Moderation. We may review, edit, refuse, or remove any Contribution at our discretion, but we are not obligated to monitor Contributions and are not responsible for content submitted by users.

7. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose or in any way that could harm the Service or other users;
  • interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems;
  • scrape, harvest, or collect data from the Service using automated means without our written permission;
  • reverse engineer, decompile, or attempt to extract the source code of the Service, except where permitted by law;
  • submit fraudulent wait-time reports or otherwise attempt to degrade the accuracy of the Service for others; or
  • resell, sublicense, or commercially exploit the Service or its content without our consent.

8. Third-party services and links

The Service integrates with and links to third-party services — including mapping and navigation providers, telephone dialing, app stores, and the websites and phone systems of healthcare facilities. We do not control and are not responsible for third-party services, their content, availability, or their privacy and data practices. Your use of any third-party service is governed by that provider’s own terms.

Calling a facility or opening directions through the Service simply passes information to your device’s dialer or maps application; we do not manage the resulting call, route, or interaction.

9. Intellectual property

The Service and its original content, features, branding, logos, and functionality are and will remain the exclusive property of The Patient Wait LLC and its licensors, and are protected by intellectual property laws. Except for your Contributions, nothing in these Terms transfers any ownership to you.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.

10. Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and share information. Please review it to understand our practices.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the above, we do not warrant that the Service will be uninterrupted, secure, or error-free; that wait times or facility information will be accurate, current, or complete; or that any facility located through the Service will be able to meet your needs. You use the Service, and rely on any information within it, at your own risk.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PATIENT WAIT LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE — INCLUDING ANY RELIANCE ON WAIT TIMES, FACILITY INFORMATION, OR DECISIONS ABOUT WHERE OR WHEN TO SEEK CARE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, TO USE THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to indemnify, defend, and hold harmless The Patient Wait LLC and its officers, members, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your Contributions, or your violation of these Terms or of any law or third-party right.

14. Suspension and termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion. You may stop using the Service at any time. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitations of liability, indemnification, and governing law — will survive.

15. Changes to the Service and to these Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing law and dispute resolution

These Terms are governed by the laws of the State of [INSERT STATE], without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved [in the state or federal courts located in [INSERT COUNTY/STATE] / through binding arbitration as described below], and you consent to that forum.

17. Miscellaneous

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
  • Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
  • No waiver. Our failure to enforce any provision is not a waiver of it.
  • Assignment. You may not assign these Terms without our consent; we may assign them freely.
